1. Agreement to Terms

By accessing or using Voz Voice Notes ("the App"), you agree to be bound by these Terms of Service. The App is operated by Nevermind Software, LLC ("we," "us," or "our").

2. Service Description

Voz is a voice cloning and translation application that allows users to:

  • Record voice samples
  • Create personal voice clones
  • Translate and synthesize speech in multiple languages
  • Share translated voice recordings

3. Voice Cloning Terms and Conditions

3.1 Permitted Use

  • You may only create voice clones of your own voice
  • You must have explicit permission to create or use voice clones of others
  • Voice clones may only be used for personal, non-commercial purposes

3.2 Prohibited Use

You agree NOT to:

  • Create voice clones of individuals without their explicit consent
  • Use voice clones for impersonation, fraud, or deception
  • Use the service to spread misinformation or create deepfakes
  • Attempt to bypass any technical limitations or security measures
  • Use voice clones to harass, abuse, or harm others

3.3 Age Requirements

  • You must be at least 18 years old to use the voice cloning features
  • Users between 13-17 may use basic features with parental consent
  • Users under 13 are not permitted to use the App

3.4 Voice Rights and Ownership

  • You retain ownership of your original voice recordings
  • You grant us a limited license to process and store your voice data
  • Voice clones created through our service:
  • Cannot be transferred or sold to third parties
  • May not be used for commercial purposes without written permission
  • May be deleted by us if unused for 12+ months

3.5 Security Measures

We reserve the right to:

  • Require voice verification steps
  • Implement additional identity verification
  • Flag suspicious activity patterns
  • Limit the number of voice clones per user
  • Monitor usage patterns for abuse

3.6 User Responsibility

You agree to indemnify and hold harmless nevermind llc and its affiliates from:

  • Claims arising from misuse of voice clones
  • Damages resulting from unauthorized voice cloning
  • Legal costs related to violation of these terms
  • Any third-party claims related to your use of the App

3.7 Geographic Restrictions

  • Service availability may be limited in certain jurisdictions
  • Users must comply with local laws regarding AI and voice synthesis
  • We reserve the right to restrict access based on geographic location

3.8 Critical Use Restrictions

The App may not be used for:

  • Emergency communications
  • Mission-critical applications
  • Medical or life-safety purposes
  • Any situation where voice authentication is required

3.9 Service Level Expectations

  • Voice clone quality may vary based on sample quality
  • We do not guarantee 100% service availability
  • Processing times may vary based on system load
  • Features may be modified or removed based on technical constraints

3.10 Abuse Prevention

  • Users must report suspected misuse of voice clones
  • We provide tools to report unauthorized voice cloning
  • We may share information with law enforcement when required
  • False reports may result in account termination

4. User Conduct

Users must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Share inappropriate or offensive content
  • Attempt to reverse engineer the service
  • Use the service for any illegal or unauthorized purpose

5. Analytics, Session Recording, and Advertising Measurement

By using the App, you acknowledge and agree that:

  • Your app sessions may be recorded and replayed through PostHog analytics, with text you type masked
  • Interaction data including screens viewed, buttons tapped, and navigation patterns is collected
  • This data is used to improve app functionality and user experience
  • Session recordings are stored for up to 90 days
  • App installs and in-app events such as viewing the paywall or subscribing may be shared with our attribution and advertising partners (currently AppsFlyer, TikTok, Meta, and Apple) so we can measure our advertising, as described in the Privacy Policy
  • Your voice recordings, voice clone, transcripts, and translations are never shared with advertising partners

You can limit advertising measurement at any time by turning off tracking for Voz in iOS Settings > Privacy & Security > Tracking, and you can ask us to stop analytics processing of your data by contacting support@nevermind.llc. Neither choice affects your ability to use the core features of the App. For details, please refer to our Privacy Policy.

6. Account Termination

We reserve the right to:

  • Suspend or terminate accounts for Terms violations
  • Remove voice clones or content that violates these Terms
  • Ban users who abuse the service
  • Modify or discontinue the service at any time

7. Premium Features

Premium subscription features, including voice cloning capabilities, are subject to:

  • Payment terms through Apple's App Store
  • RevenueCat subscription management
  • Automatic renewal unless cancelled

8. Subscription Terms

8.1 Billing

  • Subscriptions are billed through Apple's App Store using RevenueCat
  • Subscription fees are charged at the beginning of each period
  • Fees are non-refundable except as required by law
  • Prices are subject to change with notice

8.2 Cancellation

  • You can cancel your subscription through your Apple ID settings
  • Cancellation will take effect at the end of your current billing period
  • No partial refunds for unused periods

8.3 Free Trials and Offers

  • We may offer free trial periods, introductory prices, or promotional offers for Premium features
  • Trial periods automatically convert to paid subscriptions unless cancelled at least 24 hours before the trial ends
  • The exact price, trial length, and renewal terms are shown in the App before you subscribe
  • Offers may be limited to new subscribers or otherwise restricted, and may change or end at any time

8.4 Refunds

9. Data Export and Portability

We provide data export tools that allow you to:

  • Download your voice notes and translations
  • Export your usage history
  • Request a copy of all your personal data

To request an export, email support@nevermind.llc from the email address associated with your account. Data will be provided in a machine-readable format where technically feasible, normally within 30 days.

11. Intellectual Property Rights

11.1 App Content

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is our property or the property of our licensors and is protected by copyright, trademark, and other intellectual property laws.

11.2 User Content

You retain all rights to your User Content. By submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving our services.

11.3 Voice Models

While you retain rights to your original voice recordings, the voice models created through our service constitute derivative works. You receive a personal, non-transferable license to use these voice models within our App. We retain rights to the underlying technology and algorithms.

12. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, whether express or implied. We make no warranties that:

  • The service will meet your requirements
  • The service will be uninterrupted, timely, secure, or error-free
  • The results from the service will be accurate or reliable
  • Any errors in the service will be corrected

13. Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or use
  • Cost of procurement of substitute goods or services
  • Any unauthorized access to or alteration of your content
  • Statements or conduct of any third party on the service

14. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via any of the following:

  • Email notifications
  • In-App notifications
  • Posted notices in our App

Continued use of the App constitutes acceptance of modified Terms.
